Bu sözleşmeyle ödünç veren, ödünç alana bir miktar tüketilebilir eşyayı ya da parayı verme, ödünç alan da kararlaştırılan sürenin sonunda bunun mislini geri verme borcu altına girerler. Kullanma ödüncünden farkı, ödünç alınan şeyin tüketilerek yerine mislinin verilmesinde ortaya çıkar. Oysa kullanma ödüncünde bizzat ödünç alınan şeyin iadesi söz konusudur. Tüketim ödüncünün en çok karşımıza çıkan türü para ödünçleridir. Bu yönüyle pek çok kredi ilişkisinin temelini de tüketim ödüncü sözleşmesi teşkil eder. Ticari olmayan işlemlerde, sözleşmede kararlaştırılmadıkça faiz istenemez iken ticari karz ilişkilerinde sözleşmede kararlaştırılmış olmasa bile faiz istenmesi mümkündür.
