Gelir Paylaşımlı İnşaat Sözleşmesi

Abstract

Bu çalışmada, ülkemizde inşaat sektöründeki gelişmelerin bir sonucu olarak ortaya çıkmış olan gelir paylaşımlı inşaat sözleşmesi incelenmiştir. Çalışmanın birinci bölümünde gelir paylaşımlı inşaat sözleşmesinin genel esasları ele alınmıştır. Bu kapsamda sözleşmenin tanımı, tarafları, amaç ve faydaları ile unsurlarına değinilmiştir. Akabinde sözleşmenin hukuki niteliğine ilişkin değerlendirmelere yer verilmiş ve gelir paylaşımlı inşaat sözleşmesinin uygulamada rastlanan farklı biçimleri incelenmiştir. Çalışmanın ikinci bölümünde gelir paylaşımlı inşaat sözleşmesinin hüküm ve sonuçları incelenmiştir. Bu kapsamda sözleşme taraflarının hak ve borçları ile üçüncü kişilerin hukuki durumu ele alınmıştır. Çalışmanın üçüncü bölümünde gelir paylaşımlı inşaat sözleşmesinin sona erme halleri incelenmiştir.

In this study, the revenue-sharing construction contract, which emerged as a result of the developments in the construction sector in our country, is examined. In the first part of the study, general principles of the revenue-sharing construction contract are discussed. In this context, the definition, parties, purpose, benefits and elements of the contract is mentioned. Subsequently, evaluations regarding the legal characteristic of the contract is referred and different forms of the revenue-sharing construction contract encountered in practice is examined. In the second part of the study, the terms and results of the revenue-sharing construction contract are examined. In this context, the rights and obligations of the contract parties and the legal status of third parties is discussed. In the third part of the study, the termination conditions of the revenue-sharing construction contract are examined.
