Suça Sürüklenen Çocukların Ceza Sorumluluğu ve Yargılanmaları

Abstract

Children and rights of the child are among the important subjects of the present day. The child hasn’t been developed entirely in respect of biological, physiological, psychological and sociological aspects. Therefore, each child has specific requirements in order to become an adult. The society has to support development of children, adults of the future, for its own happiness, development and sustainability and has to protect them. It is incumbent upon modern society and the State to provide a legal regime to protect the rights of the child. It would be unjust to hold a child responsible and to try under criminal law in the context of the codes to which an adult is subject. Therefore, the codes and regulations in the responsibilities and the trial of the children within the framework of the criminal law according to the protection and the best interests of the children will be mentioned in our article. However, it is worth mentioning that both the state and society do not fully fulfil their obligations in these codes and in the application of these codes. So that these deficiencies would be eliminated and the children would grow happily, healthy and in peace, creating a happy and developed

Çocuk ve çocuk hakları günümüzün önemli konularındandır. Çocuk, biyolojik, fizyolojik, psikolojik ve sosyolojik yön- lerden tamamen gelişmemiştir. Bu nedenle birer yetişkin olmak için her çocuğun kendine özgü gereksinimleri vardır. Toplumun da kendi mutluluğu, gelişimi ve sürekliliği için geleceğin yetişkinleri olan çocukların gelişimini destekleme- si ve onları koruması gereklidir. Koruma için de çocuk haklarına yasal bir düzenleme getirilmesi, modern toplumun ve devletin yükümlülüğüdür. Çocuğun, bir yetişkinin tabi olduğu yasalarla ceza hukuku bağlamında sorumlu tutulması ve yargılanması adaletsiz olacaktır. Bundan dolayı, bu makalemizde çocukların korunması ve üstün yararı ilkesi gereğin- ce ceza hukuku bağlamında, çocukların sorumluluğu ve yargılanmasındaki yasa ve düzenlemelerden söz edilecektir. Ancak söz konusu yasalarda ve bu yasaların uygulanmasında hem devletin hem de toplumun yükümlülüklerini yerine tam olarak getirmediğini belirtmek de yarar bulunmaktadır. Böylece bu eksiklikler giderilsin ve çocuklar mutlu, sağ- lıklı ve huzurlu yetişip mutlu ve gelişmiş bir toplum meydana getirsinler.
