Regulations and Periods of Conditional Release From the Perspective of Collection and Sharing of Residual Value

Abstract

Human beings, by combining their strength and abilities with the faculty of judgment, are capable of generating a significantly greater surplus value compared to other living beings, stemming from the force they employ and the skills they possess. In the process of accumulating and redistributing this surplus value, the role of law is undeniable. Particularly in ensuring the continuity of the system established for the accumulation and distribution of surplus value beyond physical force, criminal law takes on a pivotal role. Since the age of enlightenment, criminal law has predominantly fulfilled this role through imprisonment. Conditional release has emerged as a response to the drawbacks of imprisonment. Conditional release became part of the Turkish legal system with the establishment of the Republic. This study will examine the stages through which conditional release has evolved and the forms it has taken since its inception in Turkish law to fulfill its role. Furthermore, in the Information Age that heralds the new millennium, the potential impacts of technological advancement, which is advancing in tandem with philosophical discourse, on conditional release as a ustadan and balancer, will be discussed.

İnsan, kuvvet ve yeteneklerini muhakeme yetisi ile birleştirerek diğer canlılara göre kullandığı kuvvetten ve sahip olduğu yetenekten çok daha büyük bir artık değer üretebilmektedir. Bu şekilde elde edilen değerin toplanması ve yeniden dağıtılması sürecinde hukukun yeri yadsınamaz. Özellikle artık değerin toplanması ve dağıtılmasına yönelik olarak kurulan düzenin fiziksel güç dışında devamının sağlanabilmesi noktasında ceza hukuku görev almaktadır. Ceza hukuku bu görevini aydınlanma çağından beri ağırlıklı olarak hapis cezası ile yerine getirmektedir. Bu görevi yüklenen hapis cezasının olumsuzluklarına karşı koşullu salıverilme ortaya çıkmıştır. Koşullu salıverilme Türk hukuk sisteminde Cumhuriyetin kuruluşu ile yer almıştır. Bu çalışmada koşullu salıverilmenin geçirdiği bu aşamalar ile Türk hukukunda yürürlüğe girdiği tarihten itibaren görevini yerine getirebilmek için aldığı şekiller incelenecektir. Sonuç yerine milenyumu karşılayan Bilgi Çağında teknolojik gelişme ile at başı iz süren felsefi zeminin hapsetme ve dengeleyicisi koşullu salıverilmeye olabilecek muhtemel etkilerine değinilecektir.
