Abstract

Türkiye’de ticari hayatın gelişmesi ve şirketlerin sayısında görülen artışa paralel olarak, şirket hisselerinin kolayca el değiştirmesini sağlayan mevzuat hükümleri nedeniyle şirket hisselerin devrinden doğan uyuşmazllkların giderilmesine yonelik davaların sayısı da artmaktadir.

In parallel to the developments in the commercial life and the increasing number of the companies, the number of the civil cases on the resolving of the conflicts regarding the transfer of the shares has also been increasing depending on the legislation enabling the easy transfer of them. Besides, the accessibility to the public companies' shares and the increasing number and range of the transactions regarding the public companies shares' transfers has been leading to the increase of the civil cases between the brokerage institutions and their clients. For all these reasons the courts decide on the delivery of the shares as part of the cases and the execution offices have to attempt to perform their duties. This may cause some issues.
