Hacizden Sonra Borcun Taksitle Ödenmesi Taahhüdü (iik M. 111)

Abstract

Bu çalışmada İcra ve İflâs Kanunu’nun 111. maddesinde düzenlenen hacizden sonra borcun taksitle ödenmesi taahhüdünün hukuki niteliği, koşulları, taahhüdün icra takibine etkisi ve taahhüde aykırılığın sonuçları ele alınacaktır. Mehaz İsviçre İcra ve İflâs Kanunu’nun 123. maddesindeki borcun taksitle ödenmesi düzenlemesinden birçok yönden farklı koşullara tabi tutularak, çok sınırlı şekilde uygulama imkânı bulan ancak tarafların menfaatlerine en uygun çözüm olan bu imkânın daha etkin olarak kullanılması bakımından yapılması gereken değişiklik önerilerine yer verilecektir.

In this study, the legal nature and conditions of the commitment to pay the debt in installments after the foreclosure, the effect of the commitment on the execution proceeding and the consequences of the breach of the commitment will be discussed which is regulated in Article 111 of the Enforcement and Bankruptcy Code. Subject to many conditions different from the regulation of the payment of debt in installments in Article 123 of the Swiss Enforcement and Bankruptcy Code, proposals will be made in order to use this opportunity more effectively, which can be applied very rare but is the most suitable solution for the interests of the parties.
