dc.description.abstract | Aile Hukuku, sağlıklı ve huzurlu bireyler arasındaki ilişkiler söz konusu olduğunda müdahalenin mümkün olduğunca az olması gereken “minimalist” bir hukuk dalıdır. Bununla birlikte, Aile Hukuku ilişkilerin ve özellikle ailedeki zayıf bşireylerin korunması gerektiğinde de müdehale kaçınılmazdır. | en_US |
dc.description.abstract | Family law is a "minimalistic" branch of law where the legal intervention should be exceptional in case of healty and peaceful relations between individuals. On the other hand, legal intervention is unavoidable in case it is required to protect the family law relations, espeacially the weak parties. Recently it is observed that the family relations in the modern legal systems has significantly changed in comparison to the past. The aim of this article is firstly to evaluate the characteristics, principles and the development of the modern family law; and secondly to focus on the cohabilitation of the same sex couples and the contractualisation of family law, which are recently the most debated issues in the modern legal systems. | en_US |
