Abstract

Climate change is broadly defined as long-term alterations in temperature and weather patterns. Extreme weather phenomena and heat-related deaths occurring today are consequences of the climate crisis. Accordingly, law is emerging as a superstructure institution in combating the effects of the climate change. However, contemporary positive law is insufficient to address it. In this regard, a recent theory, proposed to protect nature and mitigate the effects of the climate crisis, recommends granting legal rights to nature. Nevertheless, applicability of this theory is controversial. Whilst the European practice addresses environmental law from an anthropocentric perspective, Global South includes instances of granting rights to nature. This article examines the applicability of it, comparing practices in the European and Global South contexts.
