Abstract

The objective sought in Criminal Procedure Law is not formal truth, but concrete truth based on the actual events that occurred. The substantive/concrete truth sought in the criminal trial process will be revealed through the evaluation of the trial process as a whole, based on evidence obtained through lawful methods of investigation and inquiry, and the discussion of this evidence during the trial. For this reason, the most important stage of the trial is the prosecution stage in the court of first instance/event court. The most important phase of this stage is the trial phase, where it is determined whether the defendant committed the alleged crime and whether the event actually occurred. There are fundamental principles that must be followed at this stage. This is because any doubts about the specific incident that occurred earlier will be resolved during the trial, where the evidence, which is discussed verbally in front of everyone by the prosecution, defense and the court and perceived by the five senses, and the “judgment” (verdict) will be reached based on the impressions formed and the conclusions reached in light of the evidence presented and discussed during the trial. For this reason, this article will discuss the trial stage, its importance, and the principles that must be followed at this stage. Since the subject of our study is “The Principle of Judges’ Direct Communication with Evidence (Directness) within the Scope of the Right to a Fair Trial,” commonly referred to as the “Principle of Directness,” general information about other principles will be provided, and this principle will be examined in detail. Since disregarding this principle would violate the defendant’s right to a fair trial, the principle of “directness” stands out and gains importance over other principles.
