Sınır Ötesi Tele-psikiyatri Uygulamalarına Hukuki Bir Bakış

Abstract

The impact of the Covid-19 pandemic, along with the driving force of technology at the point of spending time at their homes, has created the basis for making tremendous use of the possibilities of technology. One of the most important developments in this regard has been the increase in the demand of people for tele-medicine applications who do not have the opportunity to reach doctors in person, due to the impact of the pandemic. Psychiatry is a special area of expertise in medicine and, tele-psychiatry has been one of the most preferred methods especially in terms of tele-medicine. In this study, legal issues related to cross-border tele-psychiatry applications and other important concepts in connection with tele-psychiatry in Turkey and the world have been reviewed taking into consideration of concrete examples and as well as doctrine opinions.Covid-19 salgını, bireylerin eve kapanması noktasında teknolojinin itici gücü ile beraber muazzam şekilde teknolojinin imkanlarından faydalanılmasına zemin yaratmıştır. Bu konuda en önemli gelişmelerden birisi, pandeminin de etkisi ile doktor ve hastaneye fiziken ulaşma imkânı olan kişilerin özellikle tele-tıp uygulamalarına gösterdikleri rağbetin de artmasıdır. Psikiyatri ise, tıpta özel bir uzmanlık alanı olup özellikle işbu çalışmada da detaylı şekilde irdelendiği üzere tele-psikiyatri özellikle tele-tıp uygulamaları açısından sıklıkla tercih edilen yöntemlerden birisidir. Bu çalışmada özellikle dünyada ve Türkiye’de hızla gelişmekte olan sınır ötesi tele-psikiyatri uygulamaları ve bu kavramla bağlantılı farklı hukuki meseleler özellikle doktrin görüşmeleri ve uygulamadaki güncel bazı durumlar da ele alınarak irdelenmiştir.
